Cerebral Palsy and Negligence at birth

Partner Neil Heavisides successfully litigated 6 cerebral palsy liability cases during 2011.  Of those 5 were for children who developed cerebral palsy as a consequence of negligence during their birth and 1 involved a child who was not looked after properly on a Neonatal Ward.  The actions are expected to result in combined payments of compensation running into tens of millions of pounds.   Cerebral palsy comes in many forms and thankfully those that arise because of negligence at or around the time of birth are rare.  However, when it does arise it has a devastating impact. ... PIP Breast Implants

Partner - Neil Heavisides currently acts for a number of women who are bringing claims in connection with ruptured PIP breast implants inserted in private clinics and hospitals.  Recently these implants have gained significant publicity because of fears about their safety and the grade of silicone used.  PIP itself, based in the South of France, apparently used non medical grade silicone and has since gone into liquidation without assets or viable insurance.   Neil is pursuing the cases against private clinics and hospitals on the basis that there was a contract with each of the... New Tax Incentive for Charitable Gifts

There was not much to cheer in the 2011 Budget in so far as Inheritance Tax (IHT) is concerned, however the Chancellor has decided to reward philanthropy. Those persons who leave 10% or more of their estate to charity will have the effect of reducing the IHT rate payable on death from 40% to 36%.  This new measure may give some scope for tax planning. Defective Hip Replacement Surgery

On 24th August 2010 one of the world's major manufacturers of replacement hip joints, De Puy, (a subsidiary of Johnson and Johnson) recalled two of its products in light of concerns that had been expressed regarding potential defects with the implants.
